Legal Question in Family Law in California

Dead Beat visitation

Can you petition a court order to make a deadbeat dad visit his children? He does not pay child support and will not get job to avoid paying, claims he is medically unable to work (but has not been granted permanent disability) so he will not have to pay. Therefore, if can not work he should be at least ordered to visit and assist with other needs of the children.

Re: Dead Beat visitation

He cannot be ordered to visit with the children. He can be ordered to seek employment. If he fails to obtain employment then his support can be based on his ability to earn. Support would be based on the imputed income. His failure to seek employment or pay child support could be used to charge him with contempt and sent to jail. The district attorney could also charge him with a misdemeanor failure to support his children. Keep after him for child support.
