Legal Question in Family Law in California
Deadbeat father
How do I get a emergency court date
for my kids?
It started last year when I put my
guard down and was working like
crazy. Graveyard hours crazy. I put
in a court order for half and half
custody so my boys dad could be
around them. What happened in
court, was the father got custody of
the boys.
Listen to this, he uses pot, and meth.
and all of that. Judge didnt seem to
care about his pot use around the
kids. For a hard working mom I
almost got 4 hours weekly supervised
visitation. I fought it so instead, I
have my boys for 4 hours on my
days off between the hours of 3pm
and 7pm. 1 month later my kids
father got on welfare. Two months
later I got a thing in the mail to pay
child support of more than half my
earnings. I contested that amount
and went to child support court to
get it lowered. which they did. In
the mean time 8 months later into
the father having these boys I keep
hearing about his massive drug use.
Meaning meth and all. His parents
supporting the children while the
children living with their dad. What
am I suppose to do here? My boys
are not having a good life. Help!!

To get an "emergency court date," you need to have an actual emergency. You did not appear to discuss one. It appears that you think that the court previously made a very bad decision and you would like to have the court change its decision. You can have a court review its decision and modify custody, but must there have been a "change of circumstances." You need to show how things have changed. The court will be looking for how the boys are doing in school (grades and behaviorial issues), whether there has been CPS or police involvement and similar factors.
