Death pertaining to settlement money and who gets the money without a will?
A friend recently passed away under the care of twin towers correctional ficility. The cause of death came back as ''unknown.'' The person that died was a husband his wife for no more than 2 months have they legally been married. The husband that died did not have a job nor did he at all financially provide support for his wife. The deceased person's mother payed for all of the deceased's expenses including rent, and spending money. Due to the fact that the the deceased person did not right a will and was married for such a short periond of time, my question is, who is going to get the settlement money? The mom or the wife. And if the wife does get the money, is the mother at all entitled to any of it?

your question is a bit hard to follow. however, from what i can make of it, it sounds that some if not all applicable settlement monies awarded here would pass as a community property interest to the wife of the decedent thru intestate succession (someone dying without a will). the mother who paid the "living expenses" for both husband and wife might be entitled to some form of reimbursement if she is not entitled to an intestate share of any applicable settlement monies as well. but, once again, your question was a bit hard to follow, so if you would like further legal assistance, feel free to email my office directly with more specific facts relating to the case situation and what type of settlement award is at issue.
