Declaration of Disclosure

I have recently filed for divorce from my husband of 10 years. We have no children and no joint assets. I was just informed that I need to serve him with a complete Declaration of Disclosure, Schedule of Assets and Debts and Income and Expense Declaration. It should be noted that he is in jail and has been in jail most of our marriage. Please help me understand why I am required to do this and does it need to be served to him like the Summons and Petition?

Re: Declaration of Disclosure

You are required by California law to disclose all of your assets. That includes your separate property. There is a severe penalty for no disclosing assets. There is however, no penalty for stating that property is separate, even if the court determines that it is community. You should discuss this with an attorney to fully understand your rights and obligations.
