Declaration of Paternity

When my ex-husband filed for divorce, I was not aware that I was pregnant and so child custody and child support was not mentioned in our divorce decree. The divorce was finalized when I was five months pregnant and my ex-husband did not believe that the baby was his and wasn't involved during the pregnancy. He never signed a declaration of paternity but somehow his name is on the birth certificate (he was overseas when my son was born). Does that mean he has rights to my son if he never signed a declaration of paternity? Do I have to go to court to correct this issue?
