Legal Question in Family Law in California

Can ex deduct expenses from spousal support?

I was just awarded greatly reduced spousal support following our youngest child turning 18. Some of our old court orders required me to pay 50% of the children's medical costs. My ex has decided to deduct 50% of medical costs from my spousal payments.

Is it legal for him to deduct these expenses from my spousal support?

Re: Can ex deduct expenses from spousal support?

Are you saying that you were supposed to pay 50% of the medical costs before the child turned 18 but that you did not, your ex paid 100% and now he's using "self-help" to reimburse himself? If that's the case, he's not supposed to do that, and you could probably bring him up on contempt charges in court. However, if you actually owe the money, you'll end up having to pay it one way or the other, and he could also file contempt against you....so maybe what he's doing is actually saving you both the hassle of going to court. If I've misunderstood your question, please feel free to write me back and clarify. Good luck.
