default dissolution 12/00 - now ex says omitted assets
okay. i was granted a default dissolution in 12/00. in 10/01, i received a child support order which is now over $8,000 in arrears. my ex just filed an osc - division of omitted assets and says that i intentionally omitted assets. i did not. he took so much money out of accounts that i just let it go and figured we were even. the judge is new to the family court and i think he favors my ex, who just skipped out of an osc contempt of court hearing because of a statute of limitations on the monies he was supposed to pay me to move out of the house in 1999. what should i do? i worked with the family law facilitators and they assisted me with the paperwork, but i don't believe i ever filed a schedule of assets and debts. my ex is now looking to have the judgment of dissolution revisited and we have a hearing in 9/02. HELP!!!!!

If there were any asssts, and I mean any, they can now be divided by the court. You did not state what assets he now claims were not divided by the court. The whole judgment is not necessarily revisited, only those items that were not previously divided. I sounds like you have Judge Denton, he is the newest judge. Judge Bostwick, is also a new "judge" but was previously a commissioner and is not new to the family law court. In either event, I don't think that you have major problems, but you should get a consultation with an attorney to see what you have to gain or lose. It might be a matter that is very easily settled. This sounds very complicated, you certainly need to pursue the monies owed you, and address the OSC matter. You would be well served by obtaining representation.
