Legal Question in Family Law in California

Default Judgement Approval Process (Time)

I filed for divorce on 1/17/03. My husband did not respond. My attorney filed the default paperwork. The judgment paperwork was submitted to the court on 9/15/03. It has not been rejected or approved yet. It is nearly 4 months since the paperwork was submitted. How long does it take for a judge to look at it and sign it? I'm going crazy waiting. My former name restoration paperwork is in the divorce package. I feel as if my life is in limbo. Is there any way my attorney can speed up the process? I was told that papers go in a pile on a judge's desk--new papers on the bottom. If, for any reason, the papers are pulled out, they do not go back in where they were; they start over again at the bottom. Is that true?

Welcome to the world of budgetary cutbacks and limitations. Courtrooms have been closed, and clerks have been laid off. I have seen it take 6 months, but it will vary based upon which courthouse you are referencing.

Good luck to you!
