delaying the filing of FL-160

For financial reasons, my husband and I have decided to try remaining in the same residence until we can afford to live apart. We don't want to have to sell our home and uproot our child. Can we then delay filing FL-160 until one of us physically moves out?

Living together and waiting to file the property disclosure may result in the date of separation being later than expected. An appellate court has held that there must be an action toward disolving the marriage for the date of separation to occur. The value of the house and other assets justifies the retaining of an attorney to review the facts and give you some advice.
