Delinquency in Child Support
Paternity in my case has been established. Respondent bounces child support checks and issues stop-payments. Respondent also feels the court-ordered daycare expenses of which he is to pay half of was optional. He owes me over $3000 in arrears, owed medical, and childcare expenses. I want to press charges and have all of the above support taken from his wages. Help!

NOW, IN RESPONSE TO YOUR INQUIRY --
Apply for a Wage Assignment Order. This order can include arrearages and, if the court order states a specific amount, child care costs too; howver, reimbursement of medical expenses usually is not included in a Wage Assignment Order because the amount is indeterminant. "Pressing charges" involves filing a contempt action in the court that made the order. Doing so is quite technical. Contact an experienced Family Law attorney in the California County where the order originated for specific advise and possible representation on your behalf.

You can get a wage assignment without a court hearing. You will need to file a motion to set the total amount that he owes you for back support on the child care. You may ask the facilitators office for assistance, but would be best off with you own attorney. Good Luck, Pat McCrary
