Legal Question in Family Law in California

Delinquent child support related to ex-spouse bankruptcy

My ex-husband is in the process of filing bankruptcy. He is behind on child support payments in excess of $20,000.00. He has asked me to meet with him to sign a new child support agreement, and possibly get alimony payments abolished. Will his filing bankruptcy have any impact on his paying back child support?

No. Bankruptcy does not discharge child support or alimony payments---not arrearages, and not current or future support. If anything, he'll be in a better position to pay since he won't have other bills. Good luck! If you'd like to mediate this, don't hesitate to phone!
