Legal Question in Family Law in California

Denied Contact

I recently went to mediation. My ex agreed to 50/50. The next day she told me she no longer agrees. We have a court date coming up in about 30 days. We exchanged contact info in mediation. I contacted her so that I could speak to my daughter. She told me no and hung up on me. I have called numerous times in the past week to speak with my daughter have have been deined each and every time. She now states that I'm harassing her. Can she legally do anything to me for trying to speak with my daughter? Could she do anything legally if I stopped by her work to see my daughter? My daughter stays at work with her all day as sh work for her new fiances mother in a beauty shop.

Re: Denied Contact

You need to go ex parte for a tempoary visitation order and have the court made aware of her conduct. Contact me directly.

Re: Denied Contact

You will need to file an OSC. If she goes to court first, she will put you on the defensive. I would go to court first and tell the court what's going on before she can allege that you are harassing her.

See, you can't really just stop by any time you want. Well, in a relationship where the parties are able to work things out and get along, you probably could. In this situation, you need to have scheduled visitation. If she refuses to agree to a schedule, then you need to go to court. Don't go to her work.

Re: Denied Contact

Calling several times a day everyday is generally considered as harassment. As the other attorneys stated you should go to court and request an order that you can have visits and telephone contact with your daughter.
