Legal Question in Family Law in California

dependancy court

my grandson was taken into custody by cps when my daughter was arrested and here we are 10 months later and they want to terminate services and put him up for adoption. Since her intial arrest she was bailed out but they revoked her bail due to cosigner being arrested. she is doing her jail time and due to be released on 8/5/08. The question I have is how

could cps legally put him up for adoption when she didn't get a fare chance to comply with their 6month case plan due to incarceration, and is 3 yrs old.

Re: dependancy court

From the perceptive of CPS she did not participate in the case plan and the termination of services is justified.

The preference is placement in the home of a family member. Is there a reason that the children were not placed in your home.

Consult with an attorney regarding your chances of becoming the foster parent of your grandson.

You should join the case and fight for custody or guardianship while she is in jail. Your case is critical you should consult with an attorney to understand your legal rights before you lose them.

As always consult with an attorney in your area before taking action.

Good luck.
