Legal Question in Family Law in California

Dependant Child, Divorce Parents

I would like to know what the law says about who can claim a child on their taxes - when the parents are divorced? My daughter is 11 years old, and lives with me primarily. She stays with her father 2 nights each week. We have joint physical and joint legal custody of her. He pays me child support and pays half of her child care expenses. I have always claimed her on my taxes, but now her father wants to claim her every other year. How does this work? Do I have to agree to this? Thank you.

Re: Dependant Child, Divorce Parents

It is my understanding that the parent with which the child lives with most of the time can claim the child as a dependent when filing taxes. Check with you tax preparer.
