Legal Question in Family Law in California

deposition

I am a petitioner on a case, the respondent's attorney wants to deposition me before the court hearing, I do not want to go since this only benefits the other party, my lawyer says I have to. Can I avoid going and not hurt my case.

Generally you should always follow your attorney's advice. If you don't trust him/her then find another attorney.

You can avoid the deposition by filing a request for dismissal unless the other side has requested affirmative relief in their response. In which case you would be required to attend the deposition. You may be able to plead the 5th Amendment or perhaps insanity at your deposition.
