Legal Question in Family Law in California

Help. I am desperate. Can I get a divorce in California and been living here and out of status for more than one year and my spouse is out of the country where divorce is not recognized and we have mutually agreed upon to separate and move on with our lives? You are right with what you are thinking about my status. I have nowhere to turn to and go back to. Thank you

Your status does not effect your ability to get your divorce here. Most important is that you have lived in CA at least 6 months and that your husband has been here so that CA would also have jurisdiction over him. I would highly suggest you seek legal counsel. Good luck!

You do not need to be a citizen or a legal resident to file for a dissolution. (Divorce) Your spouse does not need any contacts with California and does not even need to have visited California to have the court grant a dissolution. You should have an attorney assist you.
