Legal Question in Family Law in California

Destruction of Property

Hello, I am presently going through a divorce which is nearing completion. My wife and I are unfortunately still living together since she will not leave the house (the house is my separate property per the divorce papers). While she is here she is having periodic rage sessions where she destroys property in the house (some of it is community and some is my separate property). On the divorce papers it has a restraining order regarding property.

What can I do to stop her from continuing to destroy property? Can I notify the police and will they be able to do anything? Is there action that can be taken after the divorce depending upon property division?

Re: Destruction of Property

You should contact an attorney regarding obtaining a temporary restraining order removing her from the nome pending a hearing. If she has some place to go it will be easier to get the court to sign the temporary restraining order.
