Determination of Child Custody

What are the chances for a father to get custody fo his child in California? If the spouse is having an affair with a married man and spending less time at home because of this though it is not allowed to be admitted due to CA being a ''no fault'' state how does a father proceed in trying to get custody?

You will most likely get joint legal custody. The percentage of time spent at each parents house will be determined by the court. The court will consider that the mother has not been spending time at home. Good Luck, Pat McCrary
