I have had 50/50 custody for 9 years. I have been remarried all of that time. The first 5 years my children did not come to my home if the holiday fell on their mothers week. The last five years Thanksgiving and Christmas have fallen on mine. I allowed my ex wife to take our son to my family's home in San Francisco last year for thanksgiving. This year it falls on my week and i want him here with me. I got a letter today from her she wants a modification of the court order allowing our 15 year old son to say where he wants to be for the holidays and which parent or family memeber he wants to be with. If i do not answer her in an agreeable manner, she will take me to court have a lawyer appointed for my son and let the court decide if our 50/50 arrangement should be pursued any further. How much weight will a court give to this non sense? My son is a good kid, grades are A's and B's. No drugs or problems except when his mother wants to make plans without any regard for my plans or rights. Any response would be welcomed.

Depending upon the court and other facts in your case, the court may well continue the 50/50 time share for the children. California law and the courts favor equal involvement by fathers with the children.
