Legal Question in Family Law in California

Dissaproval for medical treatment

My child has had an orthodontic appt. for several months now. I've notified his father through letters & also mailed him the dr's estimated costs & dr's findings. I also requested for his input in this matter (ie. other dr's, his health insurance coverage) however, he never responded. Now that my son begun his orthodontic appts. and I've begun payments, my ex-calls the dr's office (not me) & tells him that he objects to the treatment. No further explanation was given. The doctor's office does not know what to do. I don't either.

My ex has known about the appt and treatment for months and now, last minuite, he calls the dr's office, NOT ME, to object to the treatment without a reasonable explanation. Obviously we do not communicate? What can I do? Should I continue with the treatment & later seek reimbursement?

Re: Dissaproval for medical treatment

Assuming that the parents have joint legal custody, you should file a request for a TRO ordering him not to interfere with the medical treatment, pending the hearing on your request for sole legal custody. You need to have sole legal custody as father is interfering with medical treatment of the child. Be sure to include in your supporting declaration the date of each notice about the pending medical treatment etc. You should get sole legal custody as that is in the best interests of the child.
