Legal Question in Family Law in California

Dissolution of Marriage

I showed at initial hearing. He didn't. All docs needed from me were provided. He never responded. Clerk told me that all I needed was proof that he was served the papers that are on file at the East County Courthouse (and I also have a copy). Called for copy of divorce decree and they said they dismissed the case. What do I do now.

Re: Dissolution of Marriage

It is difficult to say without reviewing the court file and the documents that you have. If a long time has not passed since the matter was dismissed you could file a motion to have the dismissal set aside and the case reinstated. The El Cajon court is pretty liberal about setting aside a dismissal, if that is where you have filed. Also, I question whether they told you that the case was "dismissed" or "off calendar". Otherwise you may need to file a new action. Good Luck, Pat McCrary
