division of estate after death
my father has remarried & has no will. they have no children together.
if he passes away, does the step mom get everything or is it split between myself & sister and her?
we are both over 21.

This is a probate question. As I recall the community property will go to her. His separate property will be divided between the new wife and you and your sister.

if dad doesn't leave a will then his shrare is divided as you suggested.
