if she has admitted to commiting adultry currently as we speak do i have an upper hand in court , we have t wo children together.

Re: divorce

California law is no fault. Improper conduct by one of the spouses is not an area that the court inquires into during the divorce process. Unless the conduct impacts the welfare of the children it is not addmissable.
