Legal Question in Family Law in California

I have a divorce agreement in which spousal support was set at 500.00 per month for 10 years unless she remarries. The agreed to agreement that is in its fifth year has yielded a major change with the Supreme Court ruling in regards to gay marriage.

The intent of the agreement set 5 years ago was due to my ex being in a Same sex relationship in which after our 19+ years of marriage would yield her a lifetime of support and at the time the same sex marriage was not legal. Now with the ruling and she is currently cohabitation with her same sex partner and is engaged for the last 6 months. Do I need to continue spousal support or should I file a motion to reduce or drop support?

The terms of the marital settlement agreement will determine your course of action. Take the agreement to an attorney and obtain specific legal advice.
