Legal Question in Family Law in California
Divorce and Alimony
My husband and I have been separated a month and 2 days, but not legally separated. And were dating each other trying to workout our issues. My question is, if we decide to file for a divorce in the near future, if the relationship doesnt work out. Keep in mine no children. How much alimony will I received a month? He makes $77,000 a year and I make $34,600 a year. And we both live in San Diego CA. As of now hes paying my rent, which is $1,238 a month. And I would be happy, if he just keep paying the rent. No more no lease. Thank you.

Re: Divorce and Alimony
You are probably better off with the rent payment. Guideline support would be about $900/mo, taxable to you. The rent payment is not pursuant to a court order nor to a written agreement making it support, so he can't write it off and you don't have to pay tax.
