Legal Question in Family Law in California

Divorce in America

I am married to an American woman

(we were married in California where

she now resides again) and our

relationship ended over six years ago.

We have not lived together at all in

that time and I am a British citizen,

based in the UK. She was meant to

sort out a divorce but she has not

done this yet. Is it possible for me to

action this remotely and will it be

quite straightforward as the marriage

has not been active for a long time?

Re: Divorce in America

Yes. I have handled such cases a number of times. If there are no issues other than simply terminating the marriage, no problem, it all gets handled via the paperwork submitted, no one will need to personally appear in court. Even if she were to contest something, like demand property division or request spousal support, these issues are often handled via the paperwork with your written declaration and evidence, and the court can and generally will accomodate you being available by telephone.
