Legal Question in Family Law in California
Divorce Bifurcation Form ?
I have a religious and moral need to end my 25 year marriage marriage quickly. (I have been separated from my spouse for about 3 years and am stil supporting him.) I understand that bifurcation is probably my best option as it will enable me to end the marriage and resolve issues related to assets and debt at a later date. What forms do I need to fill out to biforcate the dissolution? I have been unable to find any such form in bookstores or on sites on the internet
Please, please answer me quickly. I am quite desperate.
Thank you.

Well, you know, if you are really desperate you could always -hire a lawyer-. Short of that, most of the procedures are in the Nolo Press book (www.nolo.org) How To Do Your Own Divorce In California. Of course, that book assumes the other spouse agrees to end the marriage amicably. The basic procedure is that one files a motion to bifurcate, and when it is granted a partial judgment ending the marriage (assuming the requisite six months since filing has elapsed) can be entered. Any child custody, support, and/or property division issues are left for a later "judgment on reserved issues."

In a general sense, you need a "Bifurcated Judgment - Status Only", which we can provide you with as a form to use. The more important question is will your spouse stipulate to it. If not you will have to file a motion to bifurcate and then submit the bifurcated judgment after your motion is granted.
For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
