Legal Question in Family Law in California

Divorce

My brother recently got married and

had a baby. Now he wants a divorce

and she wants to take the baby

away. She is an alien in the US still

and doesn't have a job. Would the

judge still favor the mother? My

brother has a fulltime job, and has

housing with our mother. Please let

me know. Thanks

Once your brother files an automatic order will go into place prohibiting the mother from taking the child out of California. The father should apply for full custody.

She can't take the baby away. Go to court before she tries to leave.
