Divorce in California
My husband and I are married since
August 2006, and I am planning to
divorce him. I'm not sure if I will
need an attorney to represent me or
not base on my situations:
1. My husband has gambling problem
and have no job but still receive
supports from his parents.
2. My husband has a lot of bad debts
such as default on student loan,
charged off credit card accounts,
unpaid traffic ticket, and a
repossession of a car. Some of them
incurred before and after the
marriage.
3. All of his debt were created from
gambling and for his own luxury.
4. I've been seeing a therapist about
the stress my husband caused.
5. Both of us have no asset and no
children, but I have a full time job.
6. My husband is lazy and may not
response to my divorce request.
What should I do in order to protect
myself financially? I'm willing to pay
a fee for some legal advises. I live in
Irvine, California.

You are generally responsible for debts incurred during marriage. To cut off continued liability, you need to get divorce as soon as possible or at least file for separation. You may need to file BK.

Do you have any children together? Do you have any significant assets? You may be able to qualify for a summary dissolution. I recommend you commence your divorce proceedings immediately. The formal process will take at least 6 months. You will likely not have to pay spousal support given the amount of time you have been married.
