Divorce and Child Custody in California.

My wife just emptied our family home while I was away on a business trip. Took all the money, furniture, my three children and 10 minutes after I had walked in the door, I was served divorce papers. What are my rights in child custody and financial affairs. Is what she did legal. Does it qualify as abandonment. I did not her from her for three days and did not know where my children were at that time. Would appreciate a speedy reply. Distressed and need help.

Although she has not violated any court order, it is a possible violation of the penal code to "maliciously take and conceal" one's own child from the other parent. Make a complaint with the local police and the FBI.

You will eventually recoup the value of the furniture, bank accounts, etc. Since you were served with a summons and petition "10 minutes" later, you will note that restraining orders went into effect against her when she filed the petition and against you when you were served. Read the back of the summons and the line above the signature on the back of the Petition.

Your wife's actions may be used against her.
