Legal Question in Family Law in California

divorce child custody

When can a child decide what parent to

live with if they have joint custody?

What if a child simply wants to be with

one parent more than the other -- a

decision made on their own with no

coaxing from one parent or the other.

Re: divorce child custody

That is an individual determination upon the child. If the child is in later teens their choice may be relevant. However, the standard for a child is frequent and continuing contact with both parents.

Please contact a qualified attorney before you take any action.
