Legal Question in Family Law in California

divorce, child custody

I am currently seperated and want to divorce, but unable due to financial situation. We have a 7 year old daughter who lives with me. My husband commited adultry and decided to leave and now is living with her. He has not paid any child support since he left back in Sept. 2008. I want full custody of my daughter, since he does have a police record. What are my chances of me having full custody and he has supervised visitations?

Re: divorce, child custody

There are many factors that you have not put in your question that will be considered by the court in making a decision. The fact that he has committed adultery is of no interest to the court, unless it has an affect on the safety of the child. You should consult with an attorney, or the family court legal clinic.
