Legal Question in Family Law in California

divorce

dear sir, madam

my uncle has been in living in united state for 8 years and would like to file for divorce as his wife , she is in iran

but she is not agree for divorce, is it possible for him to file for divorce as doesnt have any contact with her since 8 years ago?

ps: before he left iran he has given her power of authorny for all his assets in iran.

Assuming that your uncle lives in California, he would also have to serve his wife with process in Iran. This is a complex, time consuming process and likely to be costly. I don't recommend that he attempt it himself.

Assuming that he has lived in the state of California for at least 6 months and in the county in which the petition for 90 prior to filing the petition.

California does not have jurisdiction over the property which is not located in the state.
