Legal Question in Family Law in California

Divorce & Debt

I'm a newlywed of 6 months. Unfortunately, the wife and I might have made a mistake. My question is, for our wedding we charged $20,000 on my credit cards. If we divorce is she obligated to help me pay off that debt?

In a general sense, charges incurred prior to the date of marriage are not allocated in a divorce case, and charges incurred on or after the date of marriage are treated as community debt and are allocated in a divorce case.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

Re: Divorce & Debt

Maybe, maybe not. The court may look at the debt as a marital obligation due to the fact it was incurred for the benefit of the community. If you are faced with this situation, definitely get an attorney.
