Divorce Decree

I was divorced three years ago and would like to amend the divorce decree. The decree states that I have a life insurance policy of X dollars with my ex-spouce as the beneficiary. Both my ex-spouce and I are in agreement to lower the amount. What forms do we need to file to change the divorce decree?

You need to file a motion to modify judgment based upon a stipulation of the parties. Just to be safe (in the event you get a super-technical judge) you should move in the alternative to convert portions of the divorce decree into a civil judgment.

In most jurisidictions you merely need a stipulation to modify the judgment. A motion is not necessary. There is no form, you should prepare it on pleading paper. The facilitators office in your county, if you have one, could help you prepare the order. Good Luck, Pat McCrary
