Legal Question in Family Law in California
My divorce is in default due to a pay stub that was not submitted. This was years ago. My divorce at that time was just suppose to be the divorce, no child, property, or alimoney issues. My ex is a very danerous person now and I would like to finalize the divorce with full legal custody of my two children one of whom is special needs. So if anything ever happens to me he has NO rights to them. He does not nor has he ever paid child support. He has a criminal background including child endangerment. He would probably fight me on this because he wants my sons SSI money. What is the first thing I have to do now? I do not have much money. Please help
Thank You

I'm not sure what your problem is or your question. A divorce cannot be in default due to failure to submit a paystub. If you have children you cannot have a divorce without custody or support issues. So without actually knowing what the status of your divorce is, the only thing I can advise is go see a lawyer with whatever papers you have from "years ago" and let them straighten it out for you.
