Legal Question in Family Law in California
divorce dragging out / no property left to settle
My divorce is dragging out 10 months now. If there is no more property to settle and the custody of the children has already been settled, how can a divorce keep going ?

If all issues are settled then you should proceed to place all agreements in a Marital Settlement Agreement, after completion of the declaration of disclosure and that agreement can be submitted to the court for incorporation into the judgment. There are procedural issues that you must deal with and so therefore it would be best to hire and attorney to complete. If everthing is resolve costs should be about $650 - $1,000. It is worthwhile giving the headache to someone else to complete. Good Luck, Pat McCrary

The divorce has to be completed and there needs to be compliance with the disclosure requirements prior to completion.
I suggest that you consult with an experienced family law lawyer or qualified Paralegal Assistant. Experience is not expensive, it's priceless!
