Legal Question in Family Law in California

Divorce

First, excuse me for being naive on these issues. It has been more than 6 months since I was served the papers. Does one of the parties have to be proactive and request the hearing? Also does one need representation in order to obtain spousal support? Lastly, I was told to find out information about this: I have mental health issues that have all been documented and I am not able to obtain a position doing the same type of work that I used to. Can this figure in to the spousal support issue at all?

I'm not sure what you mean by "request the hearing". There are several types of hearings that can be requested in family law.

One doesn't really "need" representation. However, it is difficult to represent yourself in pro per so you should have representation if you can afford it.

However, most courts have some type of facilitator's office where you can go to receive assistance in filling out necessary documents for whatever it is you are trying to accomplish.

The court only provides a place for you to get court orders and decisions. The parties must file the motions request trial dates etc.
