Legal Question in Family Law in California

Divorce

How can a family remove the family name from my brother's ex-wife who is using the name to obtain records, fraudulent address filings, credit, employment, and other fraudulent purposes. Our family is in jeopardy of having this person attempt to defraud the family, and the divorce is 13 years old.

Re: Divorce

The general rule is she can use her former husband's last name. When the name is being used for fraudulent purposes she should be reported to the police. Should the police not take action then you should consult with an attorney regarding obtaining a restraining order.
