Legal Question in Family Law in California

When the Divorce is Final?

I filed for divorce almost two years ago and it is still not final due to some issues of custody. Once our custody issues are resolved do we need to wait the six month period for the divorce to be considered final?

Re: When the Divorce is Final?

Your divorce may become final 6 months and a day after it was served on the other party or they filed an answer, whichever occurs first. You have to submit the forms including your marital settlement agreement, a Judgment, your final disclosure or waiver, a request for judgment and a declaration for judgment and finally Notice of Entry of Judgment. Ask the court about envelopes and number of copies.
