Legal Question in Family Law in California
Divorce not final
I have been in the process of a divorce since 2006. And it probably will not be finalized due to financials until 2009. We currently have a home that we both own and we look to keep until the market turns around. However, my soon to be ex impregnated his ex girlfriend. Can she go after the home that is in both our names? As I am sure she will seek child support.

Re: Divorce not final
Child support orders are vast and there are a multitude of ways to collect them. It would seem, foreclosing on a home is a drastic measure, but I would hope that the husband would pay it regularly.
Good luck.
As always please consult a qualified attorney before taking legal steps.

Consult with your attorney. However, changing title to the house to tenants in common, 1/2 interest in each tenant. This should at least make it difficult for the ex girl friend to attack your interest. You also want to get in writing that 1/2 of the house is your separate property.
