Legal Question in Family Law in California

When my divorce became final over a year ago, my ex was supposed to have taken over the mortgage of our home. I signed off the deed and he paid me my share of equity. Since then he has been uncooperative about assuming the home loan. My attorney says I shouldnt worry about it, that I am protected through the ''anti-deficiency statutes'' and all I have to do is show a mortgage broker my divorce decree to avoid problems when I go to buy another home. I want my name off the home loan. What can I do? I realize the courts can't force him to be approved for the remaining loan (which is under $ 50K and he could easily assume), but he has not completed the loan application I had the mortgage company send him months ago.

You can do a lot of things, but I would suggest that you take the advice of your attorney as all of the things that you do will probably not get you the result that you want. Good Luck, Pat McCrary
