Legal Question in Family Law in California

Divorce Never Finalized

My husband filed for divorce and the divorce was never finalized - He has remarried twice, I have never remarried. Financially do I have any rights? We have one child who is now an adult for which he did not pay child support after the age of 11 years old.

Re: Divorce Never Finalized

If you were never divorced, you are still married. Double check the court records to make sure! If you're still married, then you have all the rights you'd have under a regular divorce under CA law--community property, child and spousal support, the works. If you were in fact divorced, you may be able to to modify the decree based on the needs of your child (things pertaining to the child only). If you need to collect child support, you can use the DA's office or private service like enforcesupport.com. You may also want to discuss this with a lawyer and/or the Family Law Information Center (213) 974-5004. Good luck!
