divorce not finalized

my husband was married in the state of texas. he went to court and was divorced in july of 06 and his lawyer said he would mail him the divorce papers. thinking his divorce had been finalized we married in aug of 06. when his attorney mailed him the divorce papers they were dated 12/06. can we be charge for bigomy? what can be done to fix this? please help!

The circumstances that you describe occur all the time and none of the parties have been charged with bigamy. You and your husband should contact the Texas Attorney regarding having a judgment entered nunc pro tunc to a date in July 2006, prior to your marriage. If that cannot be done you can merely remarry. You can apply for a confidential marriage license for the second marriage.
