Legal Question in Family Law in California
divorce forms
i have been separated for 15 years, married only 3 years. my husband has moved to virginia. we haven't spoke in 14 years. we have no children or property involved. what forms must i file to finalize this divorce. nothing has been filed to this date. also, i'm not sure where he lives exactly, but i have his parents address, where he could be living, can i send the papers there?

I suggest that you seek out a qualified paralegal assistant to assist you with the forms, or go the Family Law Facilitators Office where they will fill out the forms for free.

You will have to file a petition for dissolution of marriage. Then you will have to personally serve him with the petition and a summons. He can be served by certified or registered mail, if he signs for the letter. Contact his family and ask if they can either give you his telephone number or have him call you. He may be able to get the divorce completed faster than you can. The earliest that the marriage can be disolved in California is 6 months after he is served with the summons and complaint.
