Legal Question in Family Law in California

My friend got married 15 or 16 years ago in TX, he signed divorce papers 15 or 14 years ago for the wife to file, the wife never filed papers. He got married 8 years ago, and has been in the military, his 2nd wife has been the one he has been claiming as a dependent through the military. He just found out that the 1st marriage was still legal, so does this mean that the second marriage is null and void? Both marriages were done in TX. He is in CA with the 2nd wife, the first wife is in TX. Is there any way to fix this? Do they allow backdates of divorce?

Your friend should consult a Texas attorney as to possible options. The only action he could take in California would be to file for a divorce. That would take 6 months from the date of serving the 1st wife is served.
