can someone give someone els money out of a saving account before divoce papers are serverd or filed?

Depends on to whom you are giving the money. If you are giving it to your spouse, make sure you get something in writing from the spouse that he/she received it. If you are giving it to someone else, get the permission of your spouse in writing first.
