Legal Question in Family Law in California

Divorce h4 wife not in the country

I was married about 10 months ago. I came home one day and my wife was gone. She went to an uncles place and then a few weeks later back to her home country. After talking to her it dosent seem like she wants to come back because she does not like the USA. I would like to file for a divorce and would like to know how i go about it.

Thanks

J

In a general sense, if she will cooperate by signing paperwork, you can use a process called "Summary Dissolution". Of she will not cooperate by joining you in signing the paperwork, you will have to proceed with a regular dissolution. If you do not know where she resides, you can have her served by publication in a newspaper.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
