Legal Question in Family Law in California

Divorce

My husband and I have agreed to divorce. He said I had 2 weeks to get out of his house. The house is in his name and he has always paid the mortgage. We've been married 10yrs together 14 and we have a minor child together. Do I have to leave? can he do that? dont i have rights?

Re: Divorce

You don't have to leave unless or until a court orders you to leave.

If he made mortgage payments using money he earned during the marriage, the you probably have a financial interested in the house even though the title is only in his name.

If he is the primary income earner and you spend more time with your child, then you will probably receive spousal support and child support.

Of course you have rights. You should contact an attorney in your area and discuss your matter. Good Luck!
