Re: divorce

In California there is a 6 month waiting period after the other spouse has been served. There are several steps that must be taken after service of the summons, assuming that the service is valid, which it was not in this case. A party, your husband, cannot serve the summons and petition. However, you can waive proper service. Thirty days after service of the summons and petition, if an answer is not filed, then you should receive notice of entry of your default, by mail. He would then have to mail a copy of his disclosure of assets to you. Then you would received notice of entry of the judgment and then a copy of the judgment would be mailed to you. If he has not taken action for a lengthy period of time you can file a response and then take charge of the proceedings. You would then have to serve a statement of asset on him. Then set the matter for trial.
